Scope and Duration
This limited warranty, provided by CITYNET, LLC (“CITYNET”), only covers Plume Pods purchased from or provided by CITYNET as used in connection with CITYNET Internet service and a compatible CITYNET Gateway Router. This warranty does not cover Plume Pods purchased from any other source other than CITYNET. This limited warranty lasts for a period of one (1) year from the date of purchase.
Who is Covered?
This limited warranty is extended only to the original purchaser of the Plume Pod and is not assignable/transferable nor does it extend to any other person.
What is Covered?
CITYNET warrants any failure of the Plume Pods to operate due to a defect in material or workmanship (“Operational Failure”). Pursuant to this limited warranty, if the Plume Pods experiences an Operational Failure, CITYNET will, in its sole discretion, repair or replace the affected Pod(s) equipment of like kind and quality with comparable features and functionality to the original Pod(s). Replacement equipment may be new, refurbished, or remanufactured. THERE IS NO ASSURANCE, REPRESENTATION, OR GUARANTEE THAT ANY REPLACEMENT EQUIPMENT WILL BE IDENTICAL.
What is Not Covered?
This limited warranty does not cover: (i) Plume Pods used for any commercial, public, lease or other non-residential purpose or in any manner in violation of the CITYNET Agreement for Residential Services, the CITYNET Privacy Notice or Acceptable Use Policy or any other agreement entered into between you, the customer, and CITYNET; (ii) cosmetic defects, or damage or failures that do not inhibit functionality or performance; (iii) damage or failure resulting from: improper installation or setup; use in any combination(s) not approved in the manufacturer’s specifications; unauthorized modifications, alterations, repairs or repair personnel; (iv) damage or failure caused by any physical force external to the Plume Pod(s), whether accidental, intentional or due to handling; (v) costs associated with installation or de-installation of Plume Pods; (vi) loss or damage to the Plume Pod(s) either while in storage or in the course of transit; (vii) normal periodic or preventative maintenance, inspections, cleaning, or tune-ups; minor adjustments and settings outlined in the user’s manual for the Plume Pod(s) that the user can perform; (vii) costs related to any service request that results in customer education or no problem found; (ix) Plume Pod(s) whose serial number has been altered or removed; (x) repair or replacement covered by a recall in effect at the time
of the Operational Failure; (xi) theft or loss of the Plume Pod(s); (xii) wired components replaced by wireless devices; (xiii) devices connected to the Plume Pod(s); or (xiv) consumable components.
How to Obtain Service
In the event of an Operational Failure, please contact us at 1.844.CITYNET. All claims must be reported within thirty (30) days of the Operational Failure. At CITYNET’s discretion, service will be provided by repairing or replacing the affected Plume Pod(s) by shipping replacement equipment to your service address for self-installation. The foregoing service will be provided pursuant to this limited warranty at no additional cost.
Conditions
CITYNET may, at its sole discretion, require the return of the defective Plume Pod(s) by mail as a condition to receiving replacement Pod(s). CITYNET will cover shipping costs associated with the return of the defective Plume Pod(s). This limited warranty may not be assigned or transferred to any other person.
Limitations and State Law
CONSEQUENTIAL AND INCIDENTAL DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF USE, ARE NOT RECOVERABLE UNDER THIS WARRANTY OR ANY IMPLIED WARRANTIES. ALL IMPLIED WARRANTIES WHICH MAY ARISE UNDER STATE LAW, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO THE DURATION OF THIS WARRANTY. Some states do not allow the exclusion or limitation of incidental or consequential damages or allow limitations on how long an implied warranty lasts, so the above limitations may not apply to you. This limited warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
